About these terms

These terms apply when you use backroadhooligan.com or buy from it. “We” and “us” means Backroad Hooligan. By placing an order, you agree to them, along with our Shipping, Returns & Refunds and Privacy policies.

The products

We describe and photograph every pair as accurately as we can. Colors can look different from screen to screen, and mirrored lenses change with the light.

Every pair in the Lineup has UV400 lenses. They are fashion sunglasses: they aren’t safety or impact-rated eyewear, and no sunglasses are safe for looking directly at the sun or a solar eclipse. Dark lenses aren’t suitable for driving at night.

Prices and payment

Prices are shown in US, Australian or New Zealand dollars depending on where you are (you can switch in the top bar), and you’re charged in the currency shown. Your bank may add its own conversion or international fees.

Payment is taken by Stripe when you place your order. We’ll collect any sales tax or GST we’re required to by law. Any other import duties or taxes your country charges on delivery are your responsibility.

If a price is obviously wrong (a typo or a glitch), we may cancel the order and refund you in full, even after it’s confirmed.

Orders

Your order confirmation email is a receipt. We may cancel an order, with a full refund, if a pair sells out before it ships, if we can’t deliver to the address, or if we suspect fraud.

Want to cancel? Contact us straight away. If your order hasn’t been passed to our warehouse yet (usually within 24 hours), we’ll cancel it and refund you in full.

Delivery

Shipping is free to the United States, Australia and New Zealand. Delivery times are estimates, not guarantees. Details are in our Shipping policy.

Make sure your address is right at checkout. Once your order is delivered to the address you gave, it’s yours and so is the risk.

Returns, refunds and your consumer rights

Our Returns & Refunds policy explains what happens if something arrives damaged, faulty or wrong, or doesn’t arrive at all. We don’t offer change-of-mind returns.

• Australia: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
• New Zealand: you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 that these terms don’t limit.
• United States: you have the protections your state’s consumer laws give you, including any implied warranties that can’t be excluded.

Nothing in our policies takes away rights you have under the law where you live.

Discounts and promotions

Discount codes and multi-buy offers can’t be combined: if more than one applies, checkout uses whichever saves you the most. Codes have no cash value, may have conditions or an end date, and can be withdrawn at any time. A sale price applies for the period shown.

Accounts

If you create an account, keep your sign-in to yourself. You’re responsible for what happens under it.

Our content

The name Backroad Hooligan, the logo, the photos, the names of each pair and everything else on the site belong to us. Don’t copy or reuse them without permission.

Using the site

Don’t misuse the site: no scraping, interfering with how it works, fraudulent orders, or using it to break the law.

Our liability

As far as the law allows, our liability for any order is limited to what you paid for it, and we aren’t liable for indirect or consequential loss. None of this limits rights or liability that can’t be excluded under the Australian Consumer Law, New Zealand’s Consumer Guarantees Act or Fair Trading Act, or US state law.

Governing law

If you buy as a consumer, you keep the protection of the mandatory consumer laws of the country you live in, and you can bring a claim there.

Changes

We may update these terms. The version on the site when you place an order is the one that applies to it.
